This Clarification Text has been prepared by Germaturk Spor Giyim San. ve Tic Ltd. Şti, in its capacity as data controller, to inform you about the processing of your personal data within the scope of Article 10 of the Personal Data Protection Law No. 6698 (“KVKK”) and the Communiqué on the Procedures and Principles to Be Followed in Fulfilling the Obligation to Inform.

2. Categories of Personal Data Processed
Within the scope of our activities, and depending on the nature of the service, the following categories of personal data may be processed:
- Identity information: first name, last name and similar identifying information.
- Contact information: e-mail address, phone number, address.
- Customer transaction / request information: the content of the applications, requests and messages you send us.
- Transaction security information: IP address, website usage records and technical data obtained through cookies.
Where the service so requires, special categories of personal data may also be processed within the framework of the relevant legislation and where the necessary legal conditions are met.
3. Purposes of Processing Personal Data
Your personal data is processed for the following purposes:
- Responding to and answering your contact and application requests,
- Carrying out goods, service, production and operation processes,
- Fulfilling contractual and legal obligations,
- Carrying out business processes, communication activities and website services and ensuring their security,
- Providing information to authorised persons, institutions and organisations and following up legal compliance processes.
4. Legal Grounds for Processing Personal Data
Your personal data is processed on the basis of the legal grounds set out in Article 5 of the KVKK. Accordingly, your data is processed on the grounds that it is expressly provided for by law, that it is directly related to the conclusion or performance of a contract, that it is necessary for the data controller to fulfil its legal obligation, that data processing is necessary for the establishment, exercise or protection of a right, and that data processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject. Where these grounds do not exist, your data is processed based on your explicit consent. Your special categories of personal data are processed in accordance with the conditions set out in Article 6 of the KVKK.
5. Transfer of Personal Data
In accordance with the conditions set out in Articles 8 and 9 of the KVKK, and limited to the purposes of fulfilling legal obligations and providing the service, your personal data may be transferred to authorised public institutions and organisations, judicial and administrative authorities, and the suppliers and business partners from whom we receive services to carry out our activities (for example, hosting service providers). Personal data is transferred abroad only where the conditions set out in the KVKK are met and in accordance with the relevant legislation.
6. Method and Legal Ground of Collecting Personal Data
Your personal data is collected through the contact forms on our website, e-mail, telephone and similar channels and through cookies, by fully or partially automated means, or by non-automated means provided that it is part of a data recording system. The legal grounds for the data collected are the conditions in Articles 5 and 6 of the KVKK set out in Section 4 of this text.
7. Rights of the Data Subject
Pursuant to Article 11 of the KVKK, by applying to the data controller you have the following rights concerning yourself:
- To learn whether your personal data is processed,
- To request information if your personal data has been processed,
- To learn the purpose of processing your personal data and whether it is used in accordance with its purpose,
- To know the third parties in Turkey or abroad to whom your personal data is transferred,
- To request the correction of your personal data if it has been processed incompletely or incorrectly,
- To request the deletion or destruction of your personal data within the framework of the conditions set out in Article 7 of the KVKK,
- To request that your correction, deletion and destruction requests be notified to the third parties to whom your personal data has been transferred,
- To object to a result against you arising from the analysis of your processed data exclusively by automated systems,
- To request compensation for the damage if you suffer damage due to the unlawful processing of your personal data.
8. Application Method
You can send your requests regarding the rights listed above to the data controller in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller. You can submit your application in writing with a wet signature to Anadolu Caddesi No: 552 Karşıyaka - İzmir, via a registered electronic mail (KEP) address, with a secure electronic signature or mobile signature, or by using the e-mail address you have previously notified to us and which is registered in our system, to germaturk@germaturk.com.tr.
Your application must include your first and last name, your signature if the application is in writing, the subject of your request and the contact details at which you can be reached. Your request will be concluded free of charge as soon as possible according to its nature and within thirty days at the latest; however, if the transaction requires an additional cost, the fee in the tariff determined by the Personal Data Protection Board may be charged.
